Welcome to HostOrient! By using our services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully. If you do not agree to these terms, you may not use our services.
1. Introduction
HostOrient, a part of Extent Technologies Limited, provides web hosting and related services. By signing up for our services, you agree to these terms, our Acceptable Use Policy (AUP), and Privacy Policy.
2. Service Agreement
2.1 Scope of Services
HostOrient offers shared hosting, VPS, managed VPS, BDIX hosting, Dedicated Server, BDIX Dedicated Server, BDIX Colocation, and other web services. The services you purchase will be described in detail in your chosen plan.
2.2 Service Delivery
- Services will be activated within 24 hours of payment confirmation.
- You are responsible for ensuring accurate details when signing up.
2.3 Uptime Guarantee
We provide a 99.9% uptime guarantee for shared hosting and VPS services. Downtime resulting from scheduled maintenance or issues beyond our control (e.g., DDoS attacks, natural disasters) is excluded.
3. Payment Terms
3.1 Billing Cycle
- Services are billed monthly, annually, or as per your selected plan.
- Payment must be made in advance for each billing cycle.
3.2 Refund Policy:
- Shared hosting services come with a 30-day money-back guarantee.
- Domain, SSL, Managed VPS, Email VPS, Email Services, IP PBX, and Colocation services are non-refundable once activated.
- Refunds are not applicable for violations of our AUP.
3.3 Late Payments
Invoices not paid by the due date may result in account suspension after 3 days and termination after 7 days.
4. Acceptable Use Policy
You agree not to use HostOrient services for any activities that violate applicable laws, regulations, or the rights of others. Specifically, you must not:
4.1 Prohibited Activities
- Spamming and Email Abuse
- Sending unsolicited bulk emails (SPAM) or engaging in email harvesting.
- Operating mailing lists without proper opt-in and opt-out mechanisms.
- Using services to send excessive or abusive emails that violate recipient consent.
- Malicious Activities
- Hosting, distributing, or linking to malware, viruses, ransomware, or other harmful code.
- Launching or facilitating DDoS (Distributed Denial of Service) attacks.
- Conducting phishing schemes to collect sensitive personal or financial information.
- Illegal Activities
- Hosting or transmitting content that violates copyright, trademark, or intellectual property rights.
- Engaging in activities prohibited by law, including but not limited to fraud, impersonation, and identity theft.
- Hosting adult content, gambling websites, or other content deemed illegal under Bangladeshi or international laws.
- Resource Abuse
- Overloading server resources with scripts, bots, or processes that degrade performance.
- Running mining operations for cryptocurrency or any other resource-intensive activity.
- Creating or using applications that cause excessive load, including poorly optimized scripts or unauthorized background processes.
- Harmful or Offensive Content
- Hosting or distributing content that promotes hate speech, violence, harassment, or discrimination.
- Hosting or distributing obscene, defamatory, or otherwise offensive materials.
- Publishing content that incites illegal activities or violates community standards.
- Unauthorized Access and Security Violations
- Attempting to gain unauthorized access to servers, systems, or networks.
- Interfering with the security of other clients or HostOrient’s infrastructure.
- Exploiting vulnerabilities or running penetration tests without prior authorization.
- VoIP-Related Services
- Hosting, operating, or facilitating VoIP services, including but not limited to VoIP gateways, SIP proxies, and PBX systems.
- Engaging in activities that can lead to network abuse, such as robocalls, auto-dialers, or VoIP fraud.
- Additional Prohibited Activities
- Engaging in any activity that could compromise the stability, security, or reputation of HostOrient’s infrastructure.
- Using HostOrient’s services to bypass geo-restrictions, government regulations, or content filtering systems.
- Hosting content that enables or encourages cybercrime, hacking, or illegal circumvention of security measures.
4.2 Enforcement and Consequences
- Monitoring and Investigation
- HostOrient reserves the right to monitor client accounts to ensure compliance with this policy.
- Suspected violations will be investigated, and you may be required to provide logs or evidence of compliance.
- Actions Taken
- Accounts engaged in prohibited activities may face immediate suspension or termination without notice.
- HostOrient may, at its sole discretion, remove content or restrict access to services that violate this policy.
- Repeat violations may result in permanent account termination and blacklisting from future services.
- Reporting Violations
- If you believe your account has been used without your knowledge or consent, report the incident to [email protected] immediately.
- If you identify another user violating this policy, report them to the same email address.
4.3 Client Responsibility
- You are responsible for all activity conducted through your account, including activity by employees, contractors, or third-party users you authorize.
- HostOrient services may not be resold or provided to others without prior written approval.
5. Backups and Data Protection
- 5.1 Backup Policy: Shared hosting accounts include automated daily backups. However, backups are provided as a courtesy and are not guaranteed.
- 5.2 Client Responsibility: You are responsible for maintaining your own backups for critical data.
6. Termination and Suspension
HostOrient reserves the right to suspend or terminate accounts for:
- Non-payment.
- Violations of these terms or the AUP.
- Misuse of resources that affects server performance.
No refunds will be issued for terminated accounts due to policy violations.
7. Limitation of Liability
While HostOrient strives to provide reliable and uninterrupted services, you acknowledge and agree to the following limitations of liability:
7.1 Service Interruptions and Downtime
- HostOrient is not liable for any damages, losses, or inconveniences caused by:
- Scheduled maintenance or unscheduled downtime.
- Network outages, hardware failures, or software issues.
- Issues caused by third-party vendors, upstream providers, or malicious attacks such as DDoS.
- Events beyond HostOrient's control, including but not limited to natural disasters, acts of war, or government restrictions.
7.2 Loss of Data
- HostOrient is not responsible for any data loss, corruption, or restoration issues resulting from:
- Client negligence or failure to back up data.
- Hardware or software malfunctions.
- Issues caused by third-party vendors, upstream providers, or malicious attacks such as DDoS.
- Unintentional deletion or modification of data by the client or authorized users. Security breaches caused by weak client-side passwords or unpatched applications.
- Backup Responsibility: Clients are solely responsible for maintaining current and adequate backups of their data, even if HostOrient provides optional backup services.
7.3 Indirect, Incidental, or Consequential Damages
- HostOrient shall not be held liable for indirect, incidental, special, or consequential damages, including but not limited to:
- Loss of revenue, profits, or business opportunities.
- Loss of reputation or goodwill.
- Costs incurred from delays, interruptions, or migration to alternative services.
7.4 Financial Liability Cap
- HostOrient's total liability, in any case, is strictly limited to:
- The amount paid by the client for the affected service during the most recent billing cycle.
- This liability cap applies regardless of the cause of the claim, including but not limited to breach of contract, negligence, or other legal theories.
7.5 Exclusions
- HostOrient does not guarantee:
- Compatibility of services with third-party software, plugins, or scripts.
- Performance or reliability of services used outside recommended configurations.
- Certain jurisdictions may not allow the exclusion or limitation of liability for incidental or consequential damages. In such cases, HostOrient’s liability will be limited to the maximum extent permitted by applicable law.
7.6 Client Responsibility
- Clients are responsible for ensuring the secure and proper use of their accounts, including safeguarding passwords and regularly reviewing activity.
- HostOrient will not be held liable for damages resulting from unauthorized access to client accounts caused by weak credentials or negligence.
8. Support
- 8.1 Availability: Our support team is available 24/7 via live chat or Support Ticket and email.
- 8.2 Scope of Support: Assistance is provided for server-related issues but does not include third-party application support.
9. Modifications to Terms
HostOrient reserves the right to update these Terms of Service at any time. Clients will be notified of significant changes after the modification.
10. Governing Law
These terms are governed by the laws of Bangladesh. Any disputes will be resolved in the courts of Bangladesh.
